To determine whether a venture is subject to the environmental licensing process, one should check if the activity registered in the corporate agreement is classified as a pollution source, according to Article 57 of Law No. 997 from 1976. However, activities that effectively don't require licensing, such as administrative and commercial activities, storage of finished products, among others, should be noted. The CONAMA 237 legislation from 1981 and SMA Resolution 11 from 2017 also describe the activities of ventures that are classified as mandatory for environmental licensing.

Payment of the licensing fee, corresponding to the analysis and issuance;
Issuance of the Certificate of License Exemption by the environmental agency.

The estimated time for requesting the License Exemption is 30 days, provided there are no delays or non-compliance with the client's responsibilities regarding the submission of enterprise documents.
The process for requesting the license exemption certificate is carried out in a single stage, unlike the environmental operating license. The license exemption certificate has no expiration date and should be updated if there are changes in the activity, structure, or location of the enterprise.
